Hi, We have a deposit held by Deposit Protection Service.

Resolved Question:

Hi,
We have a deposit held by Deposit Protection Service. The landlord wants to claim all of it for a replacement garage door which was damaged during tenancy (still in good working order). The tenancy ended in Aug '13 and the property was sold with garage door as is in Oct '13. Can he still claim for garage door?

tdlawyer :

Hello, welcome to the website. My name isXXXXX can assist you with this.

tdlawyer :

He has sold the house with the door as it was when you left?

Customer:

Yes he has

tdlawyer :

Then I don't see how he can claim for it at all. He has sold the property as a whole for a figure, which means he has no interest any longer in it and no longer owns the door he is seeking to claim for!

Customer:

Is there anything I can quote in the DPS Tenant Evidence to ensure that this is the descision they come to?

tdlawyer :

You can get the transfer documents from the land registry - www.landreg.gov.uk to show the transfer.

tdlawyer :

The principle is simple: if he doesn't own it how can he claim for it?

Customer:

I have screen print from Zoopla but guess this not sufficient?

tdlawyer :

No, ideally you need to the land registry docs. They're only £2 to get.

Customer:

It shows date and price of sale.

Customer:

Can Land reg be done online as deadline is Thursday?

tdlawyer :

Oh yes, all the documents are immediately available online. It's a great service and really easy to use.

tdlawyer :

Yes, it shows the date and price of sale.

tdlawyer :

On the Land Registry, that is.

Customer:

Ok, great. Was going to rely on Betterment Rule but found this site while looking for info

tdlawyer :

:)

Customer:

Anything else you can think of, please?

tdlawyer :

No, to be honest, this should be quite straight-forward for you, which is always good!

Customer:

Ok, thank you for your help :)

tdlawyer :

Thank you for your question. Have a great weekend.
