We have been converting our garage into extra room with bathroom.

Resolved Question:

We have been converting our garage into extra room with bathroom. It has building regs agreed. We have put a small window on the boundry wall next door has no buildings just land. The owner of of the land next door has said he is getting planning permission to building a bungler low on the land but he says we have to take our window away S it's on the boundry wall. Has he a legal right to force us to take away the window

wingrovebuyer :

Hello. Does the window open outwards over the neighbouring land?

Customer: Yes
Customer: It is a small frosted window that opens from the top out wards
wingrovebuyer :

Ok, thanks. Well, your extension is lawful and the window put in before the proposed development next door. This means you are not obligated to remove it. However, the window opening out over the neighbouring land technically constitutes a trespass. Accordingly, you might have to keep it closed or ensure it does not open out over the neighbouring land.
