Customer Question

Our neighbour won't let us cut branches off her trees that are overhanging onto our property. They are less than 1m away from our property, and were also cut very badly so the branches weigh down on our property and hit the side of our building and roof. What are our rights?

Hello,

You are legally allowed to cut back any overhanging branches back to the boundary between your and your neighbour, unless the tree is subject to a tree preservation order.

The branches which you cut belong to your neighbour and you can let them have these back.
