-Could you explain your situation a little more?
Customer: replied 3 years ago.

Hi I live down a by way in north hampshire which is also common land.

several adjoing properties that back onto the lane have either, fenced off part of the land and in some cases cut down mature trees, destroying a bat roosting site, and deposited large amounts of builders waste from the consruction of a extension.

I have reported all of this to the local council but they are not interested ,can i apprach any body else? is there a common land charter or society ?

Many Thanks

Robin Biggs

The land is actually owned by someone and not necessarily the local authority.
Do you know who owns it?
Customer: replied 3 years ago.

Hi as i stated,it is common land as shown on the conclusive map of registered common land and open country, area 3, central southern england issued by the country side agency

Hello my name is ***** ***** I will help with this.
Have you approached the Land Registry to see who owns it please?
Customer: replied 3 years ago.

Hi no, i thought common land was owned by the country side agency !!!! could it be owned by the local authority ?

Expert:  Ash replied 3 years ago.
It can be owned by anyone. 80% of common land is own by private people.
That is why you need to contact the Land Registry and find out. Then you know who the owner is and approach them for any issues.
However if it is a tree issue then the Council under Local Government (Miscellaneous Provisions) Act 1976 has power to act under sections 23-26 in relation to dangerous trees.
Can I clarify anything for you about this today please?
