"Without prejudice"discussion between two Lawyers - one informs the other that his client has a claim against the other lawyers client - this is how it remains.What should the so called defendant do to bring the matter to a head ?

If you are a prospective defendant why would you want to bring it to a head?

because I want to sell my property and I cannot if I do not tell the prospective buyer that somebody has made a claim about the property

Yes you would need to inform any buyer of the right of way claimed by the other person, but if you try to force the issue then a claimed right of way might become an actual right of way to your disadvantage.
