Customer Question

I have a gable end wall that needs repointing. To enable me to do this I have to place ladders on my neighbours drive. Have I any rights to do this with/without notice/permission or could I be prevented if my neighbour does not want me to?

Alex Watts :

Hello my name is ***** ***** I will help you with this.

Alex Watts :

You need to ask your neighbours permission

Alex Watts :

But if the neighbour refuses you can apply to the Court and seek an Order under the Access to Neighbouring Land Act.

Alex Watts :

This says that if you need access to land for your OWN property maintenance and the neighbour refuses you can seek a Court order

Alex Watts :

Then the court can order acess

Alex Watts :

If the neighbours refuses he would be disobeying a Court order and therefore liable to be warned, fined or sent to prison by the Judge for contempt of Court

Alex Watts :

Can I clarify anything for you about this today please?
