Resolved Question:

I own two semi detached houses that have just been built and are now complete awaiting sale. As part of these properties, there are two car parking spaces (four cars in total) on the drives at the front of the property. Unfortunately I live about 2 miles from these properties and the neighbours to these properties have decided to use these car parking spaces as if they were their own.
How do I stop this illegal parking on my property and what can I do if they continue to park there ?

Alex Watts :

Hello my name is ***** ***** I will help you with this.

Alex Watts :

Obvious question but I assume you own the land the parking spaces are on?

Customer:

Yes I am the sole Director of the Company that owns the land and the properties.

Alex Watts :

Ok - then you need to write and ask that they stop parking there or you will take further action.

Alex Watts :

If they refuse then you can issue proceedings in the County Court (or you could just put parking bollard up)

Alex Watts :

You would need to complete form N1

Alex Watts :

http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf

Alex Watts :

And N16a

Alex Watts :

http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n016a-eng.pdf

Alex Watts :

You would ask the court for an order to stop them parking.

Alex Watts :

The matter will be set down for a trial if it is contested and the Judge will give directions.

Alex Watts :

In the meantime the Judge can give an interim injunction

Alex Watts :

If the injunction is breached then they are in contempt of Court and can be warned, fined or sent to prison

Alex Watts :

Can I clarify anything for you about this today please?

Customer:

Thank you Alex

Alex Watts :

A pleasure

Customer:

Is there any point involving the local Police in this or is that a WASTE OF TIME ?

Alex Watts :

Police will not do anything, this is a civil matter

Customer:

OK I am clear now on my way forward But I will have to stick a notice on their cars

Customer:

as I am not sure where they live

Alex Watts :

Indeed. I would do that.

Alex Watts :

Can I clarify anything else for you?

Customer:

No I am finished thank you. I am aware of County Court Procedures having had experience of using the County Court procedures in the past

Alex Watts :

Great. If I could ask you to rate my answer before you go today please, the button should be at the bottom of the screen
