My neighbour has right of access to the side of his property

Hi, My neighbour has right of access to the side of his property through our back garden. There is a gate from his garden into ours and a gate on the other side of our garden from the road into our garden.
1. Does he have right of way from his garden into the road across our garden?
2. If he opens the gates does he have to close them?
