I have a pending charge for assault but during the legal process

Customer Question

I have a pending charge for assault but during the legal process I moved to Australia. My letter for a court date was sent to my home and my mum phoned and they are aware of my situation. The incident happened over a year ago. What will happen if I go home at Christmas will my passport be taken off me until I go to court. I previously lived in Glasgow Scotland

Thank you for your question.

You have to find out if the court granted a failure to appear warrant.

If so, it is likely that you will be arrested on entry to the UK, taken into custody and be taken to court to face the charge.

Happy to discuss further.

I hope this helps. Please leave a positive response so that I am credited for my time.
