We share a rights to a front garden driveway with our neighbour

Customer Question

We share a rights to a front garden driveway with our neighbour 50:50 according to our Land Register, I requested a copy of their Land Register and it too concurs with ours. They are currently under the impression that they hold the majority share.

Our neighbours are very difficult and almost refuse to speak in person about any issue. What recourse if any is available? At present there is nothing agreed between us regarding maintenance, usage, etc and all we would like to do is get something agreed between both parties amicably.

Thank you for your question.

What do the title deeds say about maintenance and usage? If the driveway is shared pro indiviso then in the absence of any other provision in the deeds the cost of maintenance is shared equally and both parties are entitled to use the driveway.

What is it that you want to meet them about?
