Scots Law my partner engaged an estate agent to sell his house

my partner engaged an estate agent to sell his house but now his daughter has expressed
her interest in buying it. If he (at the end of the contract) agrees to sell to his daughter without the estate agent does he still have to pay the selling fee of 1.3%

Thank you for your question.

As long as he terminates the estate agency contract properly and doesn't conclude a contract with his daughter until the end of the "exclusive agency" period he will not have to pay commission to the agent.
