We have a car park where 8 owners garages are sited. There

Resolved Question:

we have a car park where 8 owners garages are sited.
There is additional parking spaces adjoining these garages which other residents in the estate use.
as the estate was built 29 years ago the entire car park surface is in need of repair.
is this the sole responsibility of the garage owners?
The council state it is not their responsibility.
Our title deeds only state we own our house and the garage, but states nothing about the parking area.

Thank you for your question. I am a lawyer in Scotland and will help you with this.
Liability for repair of common areas such as car parking within a residential estate is usually a common liability of the users and this is normally specified in the Deed of Conditions for the estate.
Can you give me your Title Number and I will have a look on the Land Register for you?
Customer: replied 2 years ago.

unfortunately my lawyer sent the title deeds to land registry I believe.

Could I get back to you with perhaps my neighbours number?

Expert:  JGM replied 2 years ago.
