Customer Question

Hi, I wonder if you can help me please?
I recently lost my divorce case and my ex husband walked away with the lion's share of all marital assets. I did not qualify for legal aid but did receive emergency legal aid for a period of 4 months. The case, although the Sheriff did state was not for a lot of money was heard over 7 court days as I was defending due to assets. No inventory was taken and nothing I was defending was actually heard. I have now been awarded the expenses and got the bill in today. I have had to pay for my own solicitor and now another £15,000 for my ex husbands fees. I have absolutely no money and wondered what the minimum amount is I can pay monthly. I am not working, I'm staying with parents and I am paying my car on HP. Thanks in advance.

Thank you for your question.
There is no provision to pay in instalments unless the court makes a time to pay order on your application. I wonder if you have considered declaring yourself bankrupt which would have the effect of discharging you from the debt if you have no assets or indeed other liabilities. You would be declared bankrupt for a year and then discharged of all your debts.
So your husband would not get the expenses from you.
