I have a court summons from teleeye on a supermarket

Resolved Question:

I have a court summons from teleeye for parking on a supermarket car park. I would admit that it could be classified as trespass, however should it not be the landowner who should prosecute? are there any other loopholes?

Thank you for your question. My name is ***** ***** I will try to help with this.
Did you park there without a ticket?
Customer: replied 2 years ago.
sorry it was parking eye. they take picture of reg plate in and out. I am the registered keeper. my wife was driving car and I was not with her. I did not enter into any contract. no ticket involved. thanks

did you tell them who the driver was within 28 days of the ticket?
Customer: replied 2 years ago.
no.no correspondence at all

That is a problem I'm afraid.
The Protection of Freedoms Act 2012 makes the registered keeper liable unless he discloses within 28 days of the ticket the name of the driver.
This isn't a trespass anyway. There is direct case law on that point. A person has entered into a contract. It used to be possible to refuse to identify the driver but the new statute brings an end to that defence.
You can always put them to prove on the adequacy of signs and the sum of their loss but I have never got anywhere with the latter point.
The landowner will have delegated to the company which they are allowed to do. That is one thing that generally they have done.
Sorry but I have to give you truthful information.
Can I clarify anything for you?
