If a bycicle rider falls over a low slung rusty chain across a private road in the dark and is badly hurt, does he have a right to claim. There was no visible sign on the chain but a sign saying 'private' on the other end of the road.

What was the injury?

Why was he on private road?

Customer: replied 10 months ago.
He is an artist (painter) , had been showing his paintings in London at an exhibition and was on his way back home to unload the paintings in his studio.Took the hired van back and rode home on is bicycle. He did not want to ride on the pavement or the road so chose this private road. He shot over the chain, his glasses fell off and he fell on his face, had to go to to A & E had 7 stitches in his forehead and still has dizzy spells. He had lights on the bike front and rear.

Sorry if I am missing the point but surely the chain was to prevent entry?
