Customer Question

I have received a parking penalty notice even though I displayed the ticket. Apparently it is a 2 part ticket that the council issue so you can redeem in store. i may of displayed the redemption part, not the correct part, even though both show car registration, date and time of purchase, the 2 parts are not clear even though the council says it is clear

So, in short, they say you didn't display it?

Customer: replied 19 days ago.
because I displayed the refund section, which they say was not the right part
Customer: replied 19 days ago.
sorry, hadn't finished typing and my laptop slipped, they say the Booths voucher part should of been displayed, even though both show time of purchase, car reg, it is extremely petty and lack common sense but i know they will hide behind the law to get their valuable precious funds from innocent paying customers

Hello,
Would it be possible for an answer this evening, as I will have very limited access to emails for the next 1-2 weeksmany thnaks
Expert:  Jo C. replied 19 days ago.

Yes, I'm not clear what your question is really?

Are you asking if this is a defence?

Customer: replied 19 days ago.
Do they have a case to issue me with a ticket, can I object as the ticket displayed shows car reg, date and price?
and do you think I would be successful?
Expert:  Jo C. replied 19 days ago.

Oh yes, they do. They very definitely do. Come what may, this was not displayed. The terms require you to do so. You did not.

They do have discretionary grounds to cancel on the basis that you had paid but that does not give you a positive defence.

They may well cancel on discretionary grounds but you are over estimating the strength of your position.

The issue is not whether you paid. The issue is whether you displayed.

it is worth fighting this but in strict law they would probably win.

Can I clarify anything for you?

Jo
