Hi there, My question is regarding US Visa application. I am a British national working for a British company. My partner works for the same British company and is Lithuanian citizen. Our company would like to move us from the UK LTD to the US INC as soon as possible. E2 visa seems like the best option. However, My question is, can she travel on the E2 treaty visa as well? OR will she have to apply for a different visa because she is not British?

For your partner to be able to use the E-2 as a principle, the company would have to be at least 50% owned by Lithuanians. So the only way that I could see that working for both of you is if 50% was owned by UK citizens and the other 50% owned by Lithuanian citizens. If not, then you could marry and you would get the main E-2 and she would get an E-2 as a spouse and would need a work permit to be able to work.
