I have a query relating to a commercial lease on an office, which I am looking to terminate early.The lease has a 3 year term, Commencing 14 March 2019, with a break clause at 18 months (13 September 2020). I contacted the Landlord at 13 September to terminate the Lease as per the Break Clause but the Landlord refused, stating that notice should have been given on 13 March 2020.
The lease contract states:"If the Tenant wishes to determine thus lease at the end of the first 18 months of the term, being 13 September 2020 "The Break Date" and shall give the Landlord not less than six months' prior notice in writing then upon the expiry of such notice and provided that the Tenant has....(..paid the rent due and given back the property...) the Term shall immediately cease...."Now on the letter issued by the Landlord's Solicitor that accompanied the Lease Contract, it states:"You have a right to end the lease after 13 September 2020, on not less than six months' notice"Based on the letter, my understanding was that I could terminate the contract after 13 September 2020, but the Landlord is going by the 6 months prior notice (13 March 2020) and denying the option to implement the Break Clause.Do I have any grounds to argue my case on this, as the additional cost is significant and also we will be winding up the business through Members Voluntary Liquidation in December as it will not be viable beyond the next 6-8 months due to Covid
