It isnt a testable item on MOT so the car shouldnt fail on that issue alone - it fairly likely the failure could be the sender/pump unit in the fuel tank..the sender baiscally has a float on it that raises a small arm against a potentiometer to tell the dash/ecm what level tha fuel is in the say going by your description of whats going on the sender unit is likely need to be replaced....I do hope this helps
