New company taking over (TUPE) says im not entitled to days

New company taking over (TUPE) says i'm not entitled to days in lieu.
Is this true. With the previous company any hours I worked over my 45 I could have lieu days back.
They said "You're salaried man; you don't have lieu days"!
At present I am working around 60 hours per week, 15 hours over my contract.
Is this allowed?
