I have an employee who has a contract stating she should not

I have an employee who has a contract stating she should not use her mobile phone , but can be contacted on the shop phone if needed in case of emergency. I have previously had to have a word with her and re-explain this verbally to her. A copy of her contract is pinned up at work in case she needs to refer to it. I have also pinned up a notice saying she should not use her mobile phone. She continues to flout the no mobile policy in her contract and only yesterday I have seen her on cctv using her phone at least 20 times in a 4 hour shift. Can I do immediate dismissal for gross misconduct?
