My brother married a Turkish woman and has two children together. Unfortunately, after 9 years the marriage has broken down. My brother is concerned that a divorce will mean that his wife will have custody of the boys and she can be a little unstable and lash out at times although this has not been reported previously. He is also concerned by her threats to take the boys on a "holiday" to turkey to see her family and not come back. Please can you advise us on what his rights are and the next steps he should take.

How old are the children and how is their care shared between the parents at the moment

The boys are 6 and 4 yrs old. My brother works full time but takes care of them before and after work. His wife does not work and generally Sees to them when they are not in school/ child care. My brother and his wife still live together in the same house but he want a some advice before he agrees to a deprecation/ divorce. She doesn't allow my brother to phone his family from the house whilst she is happy to slate us all and feels that despite this restriction she has put on him, she can phone her famy in Turkey at any time. She has also stopped my brother from bringing the boys to see his family ( they live on the easy cost and we live in the north west)

How would your brother wish the care of the children to be shared between them after separation?

I would imagine he would want as much responsibility as possible. What would his chances be on this? And how does he prevent her from taking the boys away for good- if this did happen how does he get them back?
