My husband and I separated over 8 years ago and we agreed

This answer was rated:

Hi, my husband and I separated over 8 years ago and we agreed on the amount I would accept as a final settlement. He has now started talking to me about the 'three year rule' under which he says legally he doesn't have to pay me anything. What is this rule please?

There is no time limit on a finalising a settlement so it's sounds as though this could be a scare tactic on his part.

Have you started divorce proceedings? If not, I would advise you to do so as quickly as possible so that you can commence financial remedy proceedings to finalise a settlement. Any further delay could mean assets or savings could be spent. How was the orginal settlement decided? If you have any paperwork between yourself and your former husband discussing finances, such as emails, mediation notes etc then this could be very helpful to showing both your intentions.

I hope this helps to take matters forward.
