I have been ordered to sell matrimonial home that I bought before marriage and totally financed throughout marriage so that ex can rehouse himself and our now 15 yr old daughter who had been living with him at his parents. He has continually failed to give full and frank disclosure and has lied throughout divorce proceedings. I had the highest financial input and assets. Since the order he has illegally moved my daughter and himself to Scotland without a court order or my written consent and has now married the unnamed woman cited in my divorce petition. He has applied to court to enforce the sale of the house claiming to still be living at his parents. I queried this in court yesterday and his solicitor said he had moved back down at that time which would have meant he had left our daughter in Scotland without a parent. I believe the whole divorce to be a big money making exercise on his part hence why he has bribed and manipulated our daughter to live with him. I will virtually be left homeless but he has already rehoused himself and our daughter and gained another matrimonial property along the way. He clearly did not need the lump sum from the equity in our matrimonial house to rehouse himself. Where do I stand as far as this is concerned? He failed to declare his business accounts when we originally went to court claiming he couldn't get hold of his accountant. However he was registered as a Director of a company acting as general manager. I would be grateful for any advice you are able to give. I have been financially crippled through his continual lies. That is absolutely fine. From the court order now received the matrimonial house is still ordered to be sold and ex is to take over the sale proceedings. The mortgage is solely in my name so not sure how this will work? Also my daughter has stated that when she is 16 and finished her last year at school in Scotland (the next school year) she will move back with me. She is clearly not happy in Scotland and kept there against her wishes. She is spending her summer hols with me.
I still need help and advice as to what I can do and the necessary forms I may need to fill in to make applications to court to contest.
