My ex husband and I divorced 4 years ago, he was awarded 25%

This answer was rated:

My ex husband and I divorced 4 years ago, he was awarded 25% of the matrimonial home (which was my property before we married, and was always in my name). He has since re-married and has now been diagnosed with cirrhosis of the liver, my question is if my ex husband has not made a will, does his percentage of the property revert back to me and his children or does it go to his new wife?
Welcome to Just Answer
Thank you for your question.
If your ex was to die without a will then his wife would inherit:
all the personal property and belongings of the person who has died, and
the first £250,000 of the estate, and
half of the remaining estate.
If no provision is made for your children then you could consider making a claim under the Inheritance (Provision for family and dependants act) 1975.
Kind Regards
