We are going through the process of probate at the moment

This answer was rated:

We are going through the process of probate at the moment for the estate of one of my parents and have been informed that the Will maybe invalid. The Will was drafted more than 25 years ago so not going to be easy to chase the witnesses on the will who worked at the solicitor's at the time. The reason given is that the date on the front title page is different (3 days after) to the dates when the signatures were done.Does this make the will invalid? Thanks

Thank you for your question

When did the firm close down?

Customer: replied 1 year ago.
Hi ClareI'm not sure when (or if) they closed down. However I do know they are not at the original address which is on the Will.I have actually raised a seperate question moments ago on here to try and locate the solicitors details based upon the address. Thanks

Which part of the Uk?

Customer: replied 1 year ago.
Hi ClareThey were based at 181 Mitcham Lane, London.A colleague of yours on here located the name of "Spencer Gibson & Son" which were based at that address in the 1983. Not sure at this moment if they were still there in 1989 when the Will was drafted.

Has my colleague found the successor firm for you?

Customer: replied 1 year ago.
There seems to still be a company under that name which is now located in Sutton. Hopefully this is the same company.Company Name: Spencer Gibson & Son
Company address:***** Sutton, Surrey, SM1 1HT

Actually I think you will find that this is likely to be the successor company

This is important because they will have taken over the liability Insurance for the earlier firm.

That may be important as you need to account for the error on the Will - and yes if it is not resolved then the Will MAY be rejected

Please ask if you need further details

Would the successor company still retain copies of the Wills etc even after all this time (Wil was drafted in 1989).If they do retain records, would it be possible for them to correct the error?

It is possible - much depends on how good the firms are.

They may however know where the former employees are OR be aware of the problem having happened before
