This answer was rated:

My wife and I have been married for 28 years.
We have 2 grown up daughters both married and left home.
We live in the house we both own with no mortgage just utility bills to pay.
My wife wants us to separate but will not sell our house.
If I move out and rent somewhere on my own do I still have to support her until I pass away ?

Thank you for your question

My name is Clare

I shall do my best to help you but I need some further informtaion first

How much is the house worth and what other assets are there?

What income do you each have?

Customer: replied 1 year ago.
Our house is worth approx £450,000 we have no other assets.
I receive a pension of about £12,000 s year. She has a part time job earning about £5,000 a year.

How much does a one bedroom property in the same general area cost to buy?

Customer: replied 1 year ago.
Basically all I want to know is if I move out and rent a place am I still responsible to support my wife all my life because we are married that's all.
Do I have to provide for her and keep her till I pass away ?Is that what I have to do all my life.?
That's all I want to know.Myles

How old are you both and could she earn more?

Customer: replied 1 year ago.
We are both 61 years old.We do not want to divorce.Am I responsible for supporting her all my life ?
That's all I want to know.
Can you please answer that question. Thanks

Given the differences in your income you may well have a small ongoing spousal maintenance liability.

However it is very small and the fact that she is living in the matrimonial home whilst you have the expense of writing is likely to be sufficient to wipe it out

Please ask if you would like some further details
