My father separated from my mother, his wife 20 years ago

Customer Question

Hello:My father separated from my mother, his wife 20 years ago but then started living with a woman 15 years ago. She moved in to his owned home. No mortgage. She is totally kept and does not contribute financially but acts as friend and housekeeper. His will leaves her 20% of his estate. What are her rights on his demise (which sadly will be soon)?

My name is Clare

I shall do my best to help you but I need some further information first

Did your father and mother actually have a divorce?

Who are the Executors of the Will?

How much is the Estate worth?

Customer: replied 9 months ago.
No divorce or legal separation. Done in 1997. The executors are my 2 brothers. I’m qualified as a Solicitor in the UK but have never practiced there. I’m a Barrister & Solicitor here in Canada. My fathers estate is worth around $1,400,000 pounds sterling. Thanks.

What rights are you concerned about?

Customer: replied 9 months ago.
Basically what rights to his house does she have and household goods, his vehicles one with a private number plate worth 50,000 pounds. The house is worth about 600,000 pounds. She hopes to get it and turn it into a B&B. Also does she have any grounds for a resulting or constructive trust, although as I said earlier she hasn’t contributed anything financial. Thanks.
