Can my 19 year old daughter be adopted by her step dad, my husband
JA: What steps have you taken? Have you filed any papers in family court?
Customer: no nothing, we have been told beens she’s 19 he won’t be able to adopt her
JA: Family Court normally sits in a local County and Magistrates' Court. Do you know the location of the court? If not, what county do you live in?

Customer: she hasn’t seen her biological dad since she was 1 year old,

Let me see if I can help and please rate 5 stars. Bad news I am afraid. The law is very clear. To be adopted, a child must:

  • be under the age of 18 when the adoption application is made
  • not be (or have never been) married or in a civil partnership

As your daughter is 19 she can not be adopted. This does not of course mean that he can not treat her as his daughter. Happy to discuss and please rate 5 stars for my time.
