Let me see if I can help and please rate 5 stars. You can make a formal application to the court for a child arrangements order to formally spend time with your son. The court would expect you to attempt to mediate first (a MIAM), but if that didn't work then you could make an application on form C100 to spend time with your child. Hi my name is ***** ***** here to assist you. Please could advice if there was a child arrangement in place that was agreed between you and your ex during the divorce proceedings?
If there was agreed child arrangement you could seek to enforce through the courts. However if there was non, you could initiate mediation or also file for child arrangement in court. Considering his age CAFCASS I will be involved to determine his wishes and feelings. Usually if there is no evidence of harm Cafcass would recommend contact between your child and you. Should your child refuse contact, indirect contact will be recommended. You should file for child arrangement application at the family court.
