We are building an extension onto our house. We have a Permis.

Customer Question

We are building an extension onto our house. We have a Permis. The extension will go up to our boundary line. On our neighbours side there are 4 fence posts which are on their land and right up to their boundary - the cement blocks holding them in place, are partly on our land and partly on their land. When we cut the cement back to put our foundations in, they will fall down and after our extension is built, the posts will touch our walls. What is our position regarding this?
They also have a pine tree about 3 metres high, which had two trunks - one came over our boundary and we have cut it back. The other is fully on their land - the trunk is about 15 cms from our boundary. There is also a wild plum and another shrub, some of which is on our land and the rest on theirs. What can we do about this. They are very anti because they do not want us to build there, so it is difficult talking to them. I would be grateful for advice

You will need to use all your diplomacy as you cannot do anything without your neighbours' cooperation regarding the posts and the trees... Or at least minimal cooperation. Unless you wish to embark on lengthy and costly legal procedures which could last until well after your permis de construire validity date.
