Hi My husband came to uk as a visitor to see his sister and her family, he was a professional hockey player in India. He met me and we got married and applied for a spouse visa, he got the two year's spouse visa which is due to expire end of Dec 2015. we have worked very hard in the last year and half trying to establish business, he didn't have time to visit his family in the last four years back in India. he is also training to be a HGV driver right now. He has a small gap between his training in Oct 15 and wants to visit india for 3 weeks. we are not sure if its ok for him to go to india , will he have any problems when he enters back in UK end of Oct 15 as the visa expires end of Dec 15. he will be applying for indefinite leave to ramain in uk end of Nov 15 any advice would be much appreciated Mrs Asma XXX

As his visa is valid until December 2015, he is fine to visit India in October 2015 and apply for ILR in November 2015.
He should apply for ILR no more than 28 days before his visa expiry date.
