My partner and I are looking at going to Las Vegas next

Customer Question

Hello, my partner and I are looking at going to Las Vegas next year.
He has a criminal record with personal very small amount of a class a and class c drug on him and was fined for this. Also has two counts of afray on his record. All the same night. A silly drunken night four years ago.
Should we just say no on the esta or should we apply for a visa?
All seems a little extreme when there is real criminals out there.

Hello my name is ***** ***** I will help you.
Its a matter for you. There is no sharing between the UK and USA of data for criminal records. Therefore the USA are unlikely to know of any conviction.
Clearly if he answers no he would be lying and I cant suggest you do that. But if he does tick no then in reality its unlikely the USA will know about it, unless he declares it to the immigration officer.
Can I clarify anything for you about this today please?

If he says no what are the chances of been pulled up at immigration about it?

Unlikely, no guarantee but there is no data sharing for convictions.
