I am an Austral***** *****ving in London with my long term partner. We are both on Youth Mobility visas which end in 2017. My grandparents were Scottish and I understand that would be able to apply for an Ancestry Visa if I chose. With the impending tightening of immigration laws, would my partner still be able to apply for the right to work under a spousal visa if my application was successful?
Thanks for your question.
How long have you cohabited (ie same accomodation up to today's date) with your partner please?
Kind regards,

Hi Tom,
We've lived together since January this year. By the time our current visas are up (9 February 2017) we will have been living together for a touch over two years.
Thank you for your question and patience, I’m Tom and I’ll try to help you.
She will only be able to apply if at the date that you send the applications for your ancestry visas you have been living together for two years. Additionally you would have to prove this fact with the supporting document that you submit with you application.
If you have not been living together for this time then the application would be rejected.
Assuming that you can prove this then both you and your partner can apply. If you cannot prove this then the only option would be for her to marry you.
You will see from the following link that family members are permitted to apply as dependents:
My goal is to provide you with a good service. If you feel you have received anything less, please reply back as I am happy to address follow-up issues specifically relating to your question.
Kind regards,

Thank you Tom.
I have seen various news sites (such as this stating:
"The upcoming changes would be extended to include intra-company transfers, spouses right to work and see levies implemented."
Is this not applicable to the Ancestry Visa?
There will be a tightening of the rules for worker visas. This is not presently expected to include ancestry visas, because this is based on heritage..
This would also not include your wife as presently intended.
