Hello,
Why was he issued with a residence permit for 2 years in 2014? Did he not apply for indefinite leave to remain?

He had received a caution for smacking my eldest daughter for being rude to him in a public place

So he was refused indef leave to remain and issued a further 2 years leave to remain

Thank you.
In that case he should apply for indefinite leave to remain now. The minimum earnings would not apply in his case as his original application as under the rules in place before July 2012.
Hope this helps
