A tier 2 employee's visa is due to expire beginning of

A tier 2 employee's visa is due to expire beginning of February 2017 but I have a live CoS assigned to this employee which expires on the 26th July 2016, how far in advance of the expiry of his current visa can he apply for a tier 2extension.
I have just received an answer to say 28 days before expiry but I have another employee that applied quite some time before his visa expired so I feel that I have been given incorrect information.
