Can I apply for British passport with my leave to remain ID

Customer Question

Can I apply for British passport with my leave to remain ID because my spouse is British? Or is it a must to get ILR? I lived in UK for almost five years.
JA: What steps have you taken? Have you filed any paperwork with the UK government? What country do you live in? What is your citizenship?
Customer: please reread my query.
JA: Have you talked to a lawyer about the green card?
Customer: Is that automated system responding?
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: let me have a chat with the lawyer

I am a solicitor.

You must have ILR before you would qualify for British Citizenship.

But I have been advised by a lawyer I shouldn’t wait for the ILR to apply for British passport because my spouse is British and the only thing I need is to live in the UK for five years. What do you say?
Expert:  UKSolicitorJA replied 20 days ago.

That is incorrect.

You must have ILR at the point of applying for British Citizenship.

All the best
