JustAnswer® respects copyrights and expects the users of the JustAnswer site to respect copyrights as well. As per 17 U.S.C. Section 512, JustAnswer has adopted and implemented the following Takedown Procedures.
If you believe that content on this Site constitutes copyright infringement, please provide JustAnswer's Copyright Agent listed below with a Takedown Notice containing the following information:
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit JustAnswer to locate the material;
(iv) Information reasonably sufficient to permit JustAnswer to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please be aware that materially misrepresenting infringement of your copyrights could result in your liability for attorneys' fees, costs, and damages (for example, if it is determined that the challenged use of your copyrighted work was permitted by law under the fair use doctrine). Accordingly, we suggest that you consult with an attorney, prior to submitting a Takedown Notice to JustAnswer, if you are unsure whether material on the JustAnswer site infringes your copyrights.
Once we receive a Takedown Notice, we may remove or disable access to the allegedly infringing material and make a good faith attempt to notify the provider of the alleged copyright infringement of the Takedown Notice (which could include forwarding a copy of the Takedown Notice).
Providers of content on JustAnswer who are notified of a Takedown Notice regarding content they provided on JustAnswer may respond by providing JustAnswer's Copyright Agent listed below with a Counter-Notice containing the following information:
(A) Your physical or electronic signature;
(B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
(C) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
(D) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which JustAnswer may be found, and that you will accept service of process from the person who sent the Takedown Notice or an agent of such person.
Please be aware that materially misrepresenting that your content is not infringing the copyrights of others could result in your liability for attorneys' fees, costs, and damages. Accordingly, we suggest that you consult with an attorney, prior to submitting a counter-notification to JustAnswer, if you are unsure whether your content on the JustAnswer site does not infringe others ™ copyrights.
Once we receive a Counter-Notice, we may provide a copy of the Counter-Notice to the party that sent the Takedown Notice. In addition, JustAnswer may replace the removed material and/or cease disabling access to it not less than 10, nor more than 14, business days following receipt of the Counter-Notice, unless JustAnswer's Copyright Agent first receives notice from the person who submitted the Takedown Notice that it has filed an action seeking a court order to restrain the complained of infringing activity.
