Access arrangement

This answer was rated:

My ex partner was awarded access through court to my youngest child two years ago. The court document states he should pick her up from school once a fortnight. However he is away for most of the next weekend his access takes place and he is stating his step dad will be picking her up instead. I am not agreeable to this, can i say no?

What are your objections to the step dad ?

Yours sincerely

No big objection but the access was awarded to my ex partner which he fought for a long time (was unemployed and received legal aid whereas i had to pay for)but now never takes the full amount of access just picks and chooses when he wants her. I just don't think he should be picking and choosing who picks our daughter up if he is not around to take his access then i believe i should have her.

Dear Melanie.

In the narrow sense you are correct because he is the one who was awarded contact. However in the broader sense that contact with him includes his side of the family that your child may enjoy seeing and that contact should have some flexibility then it is perhaps harsh.

But the decision is yours because you can say that the contact is for your child to see and be with his father and if he is not going to be there then it should not take place.

I hope this helps. If there are any further points please reply.

Best wishes

Yours sincerely
