Customer Question

My wife reversed our car into our garage unfortunately the car got stuck in reverse and went through the back of the garage damaging the neighbours garage at the same time.
The garages are in a separate block and are not attached to either dwelling place.

Our neighbour is a structural engineer and thinks he knows everything and is setting conditions on what we are allowed to do to get the properties repaired. The claim is being made through our buildings insurance, they have had the builders quote and have approved it.

What legal rights does he have to prevent us effecting the repair? What documentation are we obliged to provide him with? What are our obligations in meeting his demands?

What legal rights do we have if he continues his obstructive behaviour?

Do your insurers agree with the repairs?

Yes they have given us the funding to proceed we just await our neighbours authorization to be on his land to effect the repair work

Do you mean you or your contractors? did he agree to this way of doing it? Has he nowchanged his mind?

Why didnt you simply let him get his own repairers in and let the insurers deal directly with him? or let him get his own in (if thats what he wants) and give him the money?
