Hi, My daughter had an accident in pe, she did not receive first aid. The accident happened at 1.30 we were not informed. It occured on the 11/11/11. She had a broken ankle and torn ligaments on both sides of the ankle. The headmaster has been unco-operative in dealing with are enquiries. He has misled the governing body with untruths about the accident and made claims about myself and my husband. He has not followed any school procedures or timeline. Our daughters education has suffered because of this, she is still receiving treatment, has had to have counselling due to depression because of this and had felt suicidal at how this was affecting her. She was 14 at the time of the accident and a rising star at netball playing at semi pro league with a promising future before her. We wish to take action against the school for lack of care after the accident, lack of educational support, emotional support. Ofsted are intending to visit the school under section 11 due to our complaint and the dept of education are investigating the case as well. Please can you advise me where I stand. Many thanks

I'm not sure on what basis you want to sue the school. I presume you don't say they are responsible for her broken ankle?

We realise accidents happen but she received no first aid so therefore there was no duty of care. She has suffered physically, emotionally and mentally to the point of contemplating suicide. She has received minimal education in her GCSE final year. The headteacher has not followed the school, lea or government procedures in dealing with any of this which is why ofsted and the dept of education are investigating our complant and as such 4 governors have now resigned. We feel that our daughter should have some form of compensation to aid her if she has to redo exams and for the trauma she has suffered. She is still receiving treatment for an injury 18mths after it happened if the school had maybe been more pro-active in contacting us or taking her to hospital it might have been a different scenerio. The accident report was done 3 days after the accident and is a catalogue of errors.
