We have a travelling fair that visits the very small green

This answer was rated:

We have a travelling fair that visits the very small green opposite our house every year for Life Boat Week. This fair ground is so close that it is impossible to hear the television or have a conversation because of the noise when the fair is running. They use strobe lights which penetrate our curtains so we have a flashing in our front room. However the worst is that over the last few years this fair has got bigger and they have installed a large wheel that is facing our house and looks directly into both our living room and bedroom. It is so bad that every year we have had to go away for a few days. Could you tell me how near a fair can legally be to a residential home

AlexWatts2013 : Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return. For now please let me know whether the green is owned by the Council.?
Customer: I am not sure I will need to look it up to confirm but I believe the ground belongs to the life Boat Charity
AlexWatts2013 : Ok. Can you check and let me know please?
AlexWatts2013 : Also have you complained to the Council about this?

I have had it confirmed that the land belongs to the council. I have not complained to the council because I wanted to know my legal position re proximity of the fair to my home and noise before I go any further. We are in the tricky position that fair raises money for the Life Boat Charity for Life Boat Week here in Selsey which is very well supported by the local community and we could become very unpopular

AlexWatts2013 : Yes and you do not want to appear unreasonable. The Council are rwaponsible for any noise and smells that come from the land and as such you can complain. Say you do not object in principle but that the size had grown and that that is the basis for the objection. I agree that the fair itself seems ok but you do not have to put up with the increase year on year. It may a
AlexWatts2013 : It may also be worth speaking with your local councillor who may also be able to assist.
AlexWatts2013 : If you wanted to you could seek an injunction to stop further development and noise.
AlexWatts2013 : I trust this fully resolves your question and if so could I invite you to take a moment to rate my service, as your feedback is important to me. If you need further information or help then please click rely. Alex
