i bought a car for £3299.00 with 3 months warrenty.(approx 8 weeks ago.)
It was advertised with aircon....
When we got it home we realised the aircon wasnt working.The garage has had it back in to fix 2 times but the next day on each occation- no aircon,and still broken..
This time we took it back he/the garage owner, says the warrenty is for engine & gearbox only.He has just telephoned me to say:That the car requires a new radiator at £150+vat,that he will fit free of charge but i have to pay for parts.
where do i stand?

the car was advertised from a local garage with aircon and came with a 3 month warrenty,although i was given no details of it when purchased on 4 june 13.

when we called the garage about the aircon for a third time the owner stated it was a warrenty for engine and gearbox cover,this wasnt mentioned at point of sale..

we where only told the car had a 3 month warrenty and never saw any paperwork.But the garage had the car in twice to fix/refill the aircon, on the third occation we are told the warrenty only covers the engine & gearbox.That we must pay for parts and he will supply labour for free.

But as mentioned we bought the car with aircon-that has never worked.He actually told us if we wanted to have aircon to lower the roof as its a soft top.

The warranty obviously does exclude air con then. That would be common. Warranties often have extreme limitations.

You can still drop back down on your rights under the SGA though. If the car was sold with air con then it should be in working order and if it isn't then that is for them to fix at no cost to you.

The only defences they could realistically raise is that the car was not sold as having working air con and I presume you can disprove that ?

You can always sue at the small claims court for any sums you have to pay.
