My father recently died following a terminal illness which was diagnosed over a year ago. He wrote a will 6 months ago for which i was appointed executor. Since the will was written my father married (2 months before his death) and i understand that his wife was then given power of attorney and that a new will had been drafted (but i do not believe this was signed before his death).
Does the will issued 6 months ago still remain in place or is this supeceded by events. Does my fathers wife now authomatically become the executor of the estate ?

Thanks you for your question. Marriage automatically revokes a will unless it was specifically made in contemplation of the marriage.

If there is no new will then he was intestate and the estate would go as to the first £250,000 to the wife and she would get a life interest in 1.2 the remainder and the rest would go to you and any other siblings.

Any near relative can apply for probate on intestacy but it is usual for the principle beneficiary to do so
