Alex Watts : Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here as you will get an email when I respond
Alex Watts : Do you accept it was your fault?
JACUSTOMER-em0jgzno- :

no I do not ,

Alex Watts : Why is that? Did you not put the brushes back correct please?
JACUSTOMER-em0jgzno- : Yes I put the brush away properly but the hose got caught under the step. The whole system wich is ment to be fastend to the ground came with me doing no damage to the van or to the brush or hose this tells me the jet wash wasn't secure to the ground
Alex Watts : If you caused the damage then your insurers will pay for it.
Alex Watts : This is because if it was caused by the negligence of you then the garage is entitled to seek payment and recover the cost.
Alex Watts : If, as you say, it was not secure to the floor then they would not be entitled to recover the cost.
Alex Watts : But this would be for your insurance and the garage to sort out.
Alex Watts : It would be for the garage to show that it was secure to the ground and caused by your negligence.
Alex Watts : If not then there would be no claim.
Alex Watts : You can chose not to claim and fight this yourself, but your Insurers will have solicitors to deal with this for you.
Alex Watts : If this answers your question could I invite you to rate my service which I hope has been excellent today, if you need more information or help then please click reply. Alex Watts : I see you have rated poor service, I have given you the legal answer. Your positive rating is very important to me.
Alex Watts : What else do you want to know so I can turn thus into a good rating?
JACUSTOMER-em0jgzno- :

I need to know if they have got enough evidence to take me to court when I clearly put the brush back in the container they provided

Alex Watts : If they have CCTV to show you had not put it back correctly then yes they can take you to court.
Alex Watts : If they do not have CCTV or can not show that you did not put it back correct then they can not take you to court.
Alex Watts : They bring the claim, they must prove it. You do not have to do anything.
Alex Watts : Does this answer the question for you?
