Is the lane privately owned as I understand it or a public highway?
The lane is a private lane supposedly owned by farm next door but am getting our deeds to check as was same owner years ago ,and we are furthest in,
sorry couldn't reply last night but was being blocked from your website
If it is privately owned can restrict the traffic yes.
But of course the owner needs to make sure there is not a prescriptive right that they are breaching.
But if not then yes the owner can restrict traffic.
Can I clarify anything for you about this today please?
prescriptive right means ?
we have of course at least right of way to our property but they could restrict the buiseness traffic flow other than the prescriptive right, there farm was sold first by the duel owner of our farms pre 1945 owner the rented our farm to our family before selling so possibly he did reserve full right of access
it is ourselves who have lived here since 1947, new neighbours just last three years max, so the nieghbours havent had twenty years continual access, other than these neighbours we all have shared access and up keep of lane with ourselves putting most of the repair both in cost and labour , which is fair as we use complete lenghth of said lane but thanks i think you have answered my question regards Phil
