Customer Question

A High Court order made provisions for my daughter that the NHS LA are responsible for. The NHS LA has not, and will not comply. How do I make an application to the High Court that the NHS LA comply. CPR 70 does not seem right to me.

The Claimant is a protected party under CPR 21 and awarded damages under CPR 41.

The Breach.
This is a claim for fraudulent and negligent misrepresentations made by the NHS LA in establishing and providing true and trustworthy figure for Periodic Payment Order Indexing. With the knowledge it is false and with the intent to deceive the protected party and the Court so as to prevent the establishment of true and proper Periodic Payment Order Indexing. Also in a fraudulently manner did nullify the court order made by His honour Mr Justice Robert Owen 10/10/2011 by the preparation of a defective financial statement relied on by NHSLA for their own benefit, but to the Claimants loss.

"(d) The form of the Order is that which best meets the Claimant's needs and CPR 21
and 41 have been complied with"
AND IT IS FURTHER ORDERED that all further proceedings in this action be stayed
except for the purpose of implementing the terms of this Order and the terms set
out in the attached Schedule, for which purpose there be permission to apply to
the Claimant, the Defendant and to the NIISLA, and ir necessary to add the NHSLA
as a party to enforce the terms of this Order
