I sold a car in April 2013 through a Vehicle Auctioneers, providing the Auction House with the V5 at that time. I received payment some two weeks later and heard no more until late August 2013 when DVLA sent me letter to say that the vehicle was registered in my name and was uninsured on the 19th August. I informed them that the vehicle had been sold through the Auctioneers in April. They insist that as far as they are concerned I was still the registered keeper in August 2013 and therefore liable for a fine. They are now taking me to court this month and have said I could expect a fine of up to £1000. Clearly the Auctioneers have not completed the V5 and forwarded this to the DVLA. It seems completely unfair that I should be penalised for the Auctioneers failings. Please can you advice. Thank you Jamie.

If I can prove that the vehicle was sold through the Auction House on the 16th April 2013 (to persons unknown by me but obviously known to the Auctioneers) and the offence was in August 2013 am I still liable for the fine and if so do I have any recourse with the Auction House for their failure to notify DVLA of the sale by sending to them the slip from the V5 Document (transfer of ownership).
