I'm preparing a bundle for county court and I note that in the bundle index the wintess statements have been omitted. I've questioned the defendant on this and they have claimed this:

"In relation to the witness statements, it is not usual to include them in the bundle. Obviously, the court will need us to bring copies of the witness statements to the hearing but they are usually kept separate from the bundle."

Is this correct? Why wouldn't the statement form part of the bundle?

The case is a mulit track, failure to make reasonable adjustments, provision of goods and services.
