Was the name on the cheque or was the name altered please?
I am based in Ireland (Dublin). Cheque was on my name from Social Welfare.
Ok - so it was issued in your name. Have you spoken to the cheque issuer please?
Cheque Issuer is Social Welfare - I filled the form of stolen/lost cheque - I've been told to go to Gardai(police) and there nothing they can help me with ....
Do you know that it was cashed in someone else's account?
I dont have such information because Bank Agent refused to give me any information
It is the responsibility of the issuer.
You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this recorded delivery and keep a copy.
If they do not refund you then you can issue proceedings in the County Court
The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.
If the matter is defended it will be set down for a trial. Given the value you could represent yourself.
It is for the issuer to make sure that the proper person gets the cheque and cashes it.
Therefore its not responsibility - it is the issuer.
